A Mobile, Alabama homeowner is cooperating with police after shooting and killing an intruder who broke into the home through a window Monday night. Officers responded to a shots-fired call on Calgary Drive, where they found 37-year-old David Lee Jr. deceased. Preliminary investigation indicates the homeowner fired in response to Lee forcing his way inside. The Mobile County District Attorney’s Office is now reviewing the shooting as a potential self-defense case.
Alabama is a stand-your-ground state. That means a person who is in a place where they have a legal right to be, including their own home, has no duty to retreat before using force. When an intruder unlawfully enters a residence, the law presumes the homeowner reasonably feared imminent death or serious bodily harm. That’s a significant legal shield, but it’s not automatic. The DA will examine whether the force used was proportionate and whether the homeowner’s actions align with the circumstances of the break-in.
