The two brothers accused of assisting in the killing of a homeless man in Arcadia last December are set to go free with probation. Kyle and Brett Johnston took a plea bargain in agreement to cooperate with authorities. An additional suspect Gary Stanka, 32, is facing a second-degree murder charge.

An eyewitness said the two brothers held the man down while Stanka proceeded to beat him. The man known as “The Can Man” around town died of his injuries which included a brain hemorrhage, crushed windpipe and multiple cuts and bruises. He died  with his beloved pet Cheeto by his side last December 23rd at Tidewell Hospice Care in Arcadia.  Sebastian, 69, was an iconic figure in Arcadia, known for pushing a cart of scrap metal thru the town with his shaggy red dog by his side. Cheeto has since been adopted by a loving home.
