Two-year-old Darwin Olson was killed by a vehicle near Lake and Sunset roads in Ironwood, Michigan, on March 19. Investigators identified the driver, but the Gogebic County prosecutor declined to file criminal charges, and the case has now closed. For Darwin’s mother, Jessica Fernandez, that outcome has brought more questions than closure. She says she learned of her son’s death from an officer at emergency barricades, not from a formal notification.
Fernandez says officials told her they could not win the case and that nothing criminal was presented. Gogebic County Sheriff Jorge Cruz says a full police report identifying the driver was provided to her attorney. On Friday, community members gathered for a candlelight vigil outside the Gogebic County courthouse, and Fernandez says she may pursue private legal action.
