An Arizona appeals court on Wednesday vacated the 10 1/2-year manslaughter sentence of Gabriel Horcasitas, ruling that an AI-generated video of the victim prejudiced the sentencing judge and made the punishment fundamentally unfair. The underlying conviction still stands, and Horcasitas will face a new sentencing hearing. The case stems from a November 2021 road-rage confrontation that killed Christopher Pelkey.
At the original sentencing, Pelkey’s family played a video created with artificial intelligence using an earlier recording of him, a photograph, and a script written by his sister. The judge said he loved the video and noted the obvious forgiveness in Pelkey’s AI statement before issuing the sentence.
The ruling is seen as one of the first major legal tests of whether AI-generated victim statements can influence criminal sentencing, a question courts nationwide will likely confront as the technology becomes more accessible.
