A Manatee County mother is facing a criminal charge after her 4-year-old son shot himself with her handgun earlier this summer. Diamond Sharee’Nicole Phillips, 29, was arrested Sept. 22 on a charge of culpable negligence involving a firearm accessible to a minor, according to the Manatee County Sheriff’s Office. She was released the following day on a $10,000 bond.
The arrest report says the child found a loaded .380 caliber Smith & Wesson pistol in his mother’s purse on the kitchen island on the evening of June 21, at a home on Hidden Circle East in Sarasota. Investigators believe he was looking down the barrel when the gun fired. Phillips told deputies she carries the loaded gun for protection and typically unloads it and stores it out of her children’s reach at home, but she did not unload it that night.
The case underscores a conversation that repeats across Florida and the country every year: how safely are guns stored in homes where children live, and what legal consequences can follow when a child gets access. Florida law allows charges when a minor gains access to a firearm through culpable negligence.
