A Davenport, Iowa mother is facing child endangerment and OWI charges after police say she crashed her car into a telephone pole Monday evening with her child in the back seat. According to authorities, a witness saw Kayla M. Delay, 36, walking away from the crash with the child, who had facial bruising, swelling, and a bleeding nose and was taken to a hospital. Officers described Delay as unsteady and slurring her words, and she refused field sobriety and breath tests. An open alcohol container and a THC vape pen were found, and she bonded out of the Scott County Jail before midnight.

The case touches on issues that hit home well beyond Iowa. Refusing a sobriety test may feel like a way to avoid trouble in the moment, but officers document the refusal, and it can carry consequences of its own. Add an open container and suspected THC impairment to the picture, and the legal exposure grows quickly. For parents, the child endangerment charge is the heaviest piece of all, because a child had no say in getting into that car.
